CHAMPIONS TOUR PICK ‘EM CHALLENGE

OFFICIAL RULES

By participating in this contest, entrants agree to these official rules.

ELIGIBILITY

1. The CHAMPIONS TOUR PICK ‘EM CHALLENGE (the “Contest”) is conducted by PGA TOUR Licensed Properties, Inc. (the “Sponsor” or “PGATOUR.COM ”) and is open to legal residents of the United States and Canada (excluding Quebec) who are 18 years of age or older at time of entry (unless otherwise specified), except employees of PGA TOUR, Inc., Exponentia Communications Corporation, affiliates, subsidiaries, and successor companies, Contest sponsors, advertising and promotion agencies, Contest prize suppliers, participating advertisers, and immediate family members of anyone so situated. "Immediate family members" shall include spouses, siblings, parents, children, grandparents, and grandchildren, whether as "in-laws", or by current or past marriage, remarriage, adoption, co-habitation or other familial extension, and any other persons residing at the same household location, whether or not related.  Participation in the Contest acts as each participant’s authorization and subscription to be included in Sponsor communications, including email, regarding information, updates and offers of PGA TOUR, its sponsors, tournaments and affiliates, subject to exercise by the participant of a provided option to opt out of such inclusion. Eligibility to participate in the Contest is not dependent upon inclusion in Sponsor communications.


HOW TO ENTER

2. The Contest begins on Wednesday, August 10th, 2011 12:01:00 PM ET and ends Sunday, October 16th, 2011 11:59:59 PM ET.

3. There is no purchase necessary to enter the Contest. To enter, please follow these steps: 1) Use your computer’s internet browser to go to the Contest home page at http://www.championstourchallenge.com ; 2) register for the Contest; 3) once registered, select a Champions Tour golfer from the golfers listed; and 4) click submit and you are entered (each, an “Entry”). Once you have registered, to participate in future games, simply log-in using your Contest account information (username and password) and repeat steps (3) and (4). No entries will be accepted by any other means.

4. All entries must be submitted by each week’s deadline time as specified in the Countdown window at the Contest site, in order to be eligible to earn points for that week’s game.  The deadline time will be the scheduled first tee time for that week’s tournament.  There are a total of six (6) weekly tournaments defined in EXHIBIT A: THE TOURNAMENT SCHEDULE below.  Eligible participants will be awarded points based on their golfer selection for a given week, earning a point for every Charles Schwab Cup point their selected golfer earns.

In the event of ties, tiebreakers will be used to determine winners (tiebreaker process is defined in section 6 SELECTION OF WINNERS).  The results and points standings will be posted at the Contest site at www.championstourchallenge.com at or about 12:00pm ET the day after the conclusion of each week’s tournament. A new game will be conducted for the next week immediately at the deadline of the previous week.

All entries become the sole property of Sponsor and none will be returned for any reason. All entries must be received during the Contest Period. Entries will be declared invalid if they are late, illegible, incomplete, damaged, irregular, mutilated, forged, falsified, altered, garbled, mechanically or electronically reproduced, or tampered with in any way.

Entries received online shall be deemed to be submitted by the authorized account holder of the e-mail address associated with the Entry. For the purpose of the Contest Rules, “authorized account holder” of an e-mail address means the natural person who is assigned to an e-mail address by an Internet access provider, on-line service provider, or other organization responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address. Potential winner may be required to provide Sponsor with proof that the potential winner is the authorized account holder of the e-mail address associated with the winning Entry.

PRIZES

5. There will be a maximum of seven (7) prizes awarded in total for this Contest (each a “Prize”). Six (6) prizes will be awarded for each week of play for the “Weekly Winner’s Prize” which is based on the highest score for a given week of play. The Prizes will be awarded at the conclusion of each week of play. One (1) Prize shall consist of an "Overall Winner’s Prize" and will be based on the highest aggregate score for all weeks. This Prize will be awarded at the conclusion of the final week of play. The odds of winning the Prizes depend upon the number of eligible entries received. All game week dates and submission deadlines will be determined by the Sponsor.

The Overall Winner’s Prize is a trip for two (2) to the 2011 Charles Schwab Cup Championship (November 3 – 5, 2011), and shall consist of the following:

  • Roundtrip flights for two (2) to San Francisco, CA during the Charles Schwab Cup Championship
  • Two (2) Invitations to Champions Tour President’s Dinner on Thursday, November 3, 2011
  • Two (2) Clubhouse tickets (Thursday, November 3, 2011 – Sunday, November 5, 2011)
  • Hotel stay (Thursday, November 3, 2011 – Saturday, November 5, 2011)
The Overall Winner’s Prize has an estimated retail value of $4,500USD.

The Weekly Winner’s Prize shall consist of the following: one (1) dozen Nike ONE Vapor Golf Balls with the Champions Tour logo, with an estimated retail value of $44.99USD.

Prizes are non-transferable and non-exchangeable. No substitution or cash equivalent will be made. Sponsor reserves the right to substitute a prize of equal or greater value. Furthermore, Sponsor is not responsible for cancellations or delays in travel accommodations and has no obligation to reimburse, refund or otherwise substitute any tickets awarded as a part of a travel prize due to such cancellations or delays.  All expenses and costs not expressly listed above including, but not limited to, travel, meals, taxes and tips are the winner’s sole responsibility.

SELECTION OF WINNERS

6. The participant who accumulates the most points during a week as determined at the end of such week will qualify to win the Weekly Winner’s Prize for that week. In the event of a tie, two tiebreaker questions will be used in order until a winner is determined.  The tiebreaker questions in order are:
  • Tournament Winning Score
  • Total Tournament Birdies
The participant with the minimum absolute difference between the participant’s tiebreaker prediction and the actual result will be the winning tiebreaker.  If no tiebreaker value is entered, a participant’s default tiebreaker value will be zero (0).  In the event a Weekly Winner is not determined after applying this tiebreaker format, the participant with the earliest contest registration date/time will be selected as the winner.

The participant who accumulates the most points during all weeks of game play as determined at the end of the final week will qualify to win the Overall Winner’s Prize for the Contest Period. In the event of a tie, two tiebreaker questions will be used in order until a winner is determined.  The tiebreaker questions are:
  • Winning Score for final tournament (AT&T Championship)
  • Total Tournament Birdies for final tournament (AT&T Championship)
The participant with the minimum absolute difference between the participant’s tiebreaker prediction and the actual result, will be the winning tiebreaker.  If no tiebreaker value is entered, a participant’s default value will be zero (0).  In the event an Overall Winner is not determined after applying this tiebreaker format, the participant with the earliest contest registration date/time will be selected as the winner.

Each qualifying participant will be contacted by e-mail at the e-mail address provided on the Entry. If a winner is unreachable after four (4) days, or if that winner is unavailable for prize fulfillment, an alternate winner will be selected.  Winners will be required to sign and return an affidavit of eligibility and liability/publicity release (where legal) within four (4) days of notification attempt or the prize will be forfeited and an alternate winner will be selected.

7. Each winner is responsible for all federal, state and local taxes and will be required to complete an IRS form W-9 in association with such responsibility. Sponsor reserves the right to withhold prizes until a completed form W-9 is received.


SKILL TESTING QUESTION


8. In order to be eligible to win the Prize, the selected eligible entrant shall be required to correctly answer a time-limited, mathematical skill-testing question, without assistance of any kind, whether mechanical, electronic or otherwise. The selected eligible entrant may be required to swear an affidavit indicating compliance with this section. The skill-testing question will be administered by telephone.


LIMITATION OF LIABILITY

9. Entrants may not play with multiple e-mail addresses, nor use any device to play multiple times or as multiple contestants. Limit one registration per person and per e-mail address. Void where prohibited by law and subject to all applicable laws. Sponsor reserves the right to cancel, terminate or modify the Contest if it is not capable of completion as planned for any reason, including, but not limited to, infection by computer virus, bugs, tampering, unauthorized intervention or technical failures of any kind. The decisions of Sponsor are final. All federal, state and local laws and regulations apply. Sponsor, Exponentia Communications Corporation, their respective parents, subsidiaries and affiliates, their officers, directors, agents, stockholders, insurers, and employees, and their advertising and promotional agencies and sponsors assume no responsibility or liability whatsoever for damages, loss or injury resulting from participating in the Contest or acceptance or use of any prize. In consideration of participation in the Contest, and for other good and valuable consideration, the receipt and sufficiency of which are hereby acknowledged, the entrant, on entrant's behalf, and on behalf of entrant's heirs, successors or assigns, administrators and personal representatives, does hereby COVENANT NOT TO SUE, FULLY RELEASE AND FOREVER DISCHARGE (i) Sponsor, (ii) Exponentia Communications Corporation and each of their respective direct and indirect parents, subsidiaries, affiliates, partners and related entities, (iii) each of their respective directors, officers, employees, agents, insurers, attorneys, shareholders and representatives, and (iv) each predecessor, successor, and assign thereof, from and against any and all actions, charges, claims, losses, costs, damages, expenses (including attorneys' fees and expenses) and liabilities of any kind or character, whether known or unknown, in connection with, arising out of or in any way related to entrant's participation in the Contest.

10. Participants are solely responsible for timely receipt of entries. Entries are subject to verification and will be declared invalid if they are late, illegible, incomplete, mechanically reproduced, mutilated, forged, falsified, altered or tampered with in any way. Sponsor, Exponentia Communications Corporation, their parents, subsidiaries and affiliates, their officers, directors, agents, stockholders, insurers, and employees, and their advertising and promotional agencies and sponsors are not responsible or liable for late, lost, incomplete, illegible, misdirected, stolen, delayed, damaged or destroyed entries, notifications, or replies; for lost, interrupted, inaccessible or unavailable networks, servers, Internet Service Providers, websites or other connection, related to the Contest; for errors of any kind, including but not limited to human, electronic, mechanical and/or technical in nature; for failure or technical malfunction of any telephone network or lines, computer and online systems, servers, computer equipment, software, e-mail, players, or browsers on account of technical problems or traffic congestion on the Internet, the Contest website, any related website, or any combination thereof or otherwise; for any injury or damage to entrant, entrant’s computer, or any other person’s computer related to or resulting from participating in or downloading material in connection with the Contest; for incorrect or inaccurate information; and/or for weather conditions, event cancellations, delay or rescheduling or other factors beyond the Sponsor’s control. Sponsor is not responsible for any prize offered or any aspect of the Contest appearing on an advertiser's web banner or hyperlink located on the Contest website.

DISQUALIFICATION


11. All participants agree to be bound by these rules. Sponsor, in its sole discretion, further reserves the right to disqualify any person for (i) violating any of these rules, (ii) tampering with the entry process or the operation of the Contest website, (iii) gaining an unfair advantage in participating in the Contest, (iv) obtaining winner status using fraudulent means, or (v) engaging in otherwise unsportsmanlike, disruptive, annoying, harassing, or threatening behavior. Furthermore, any resale or auction or attempt to resell or auction of complimentary prizes, if any, will result in disqualification for all future Sponsor contests. ANY ATTEMPT BY A CONTESTANT OR ANY OTHER INDIVIDUAL TO DELIBERATELY CIRCUMVENT, DISRUPT OR DAMAGE ORDINARY AND NORMAL OPERATION OF THIS CONTEST, TELEPHONE SYSTEMS OR WEBSITE, OR UNDERMINE THE LEGITIMATE OPERATION OF THE CONTEST IS A VIOLATION OF CRIMINAL AND CIVIL LAWS. SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH PARTICIPANT TO THE FULLEST EXTENT PERMITTED BY LAW.


12. This is NOT a gambling site, and is not intended to be associated with gambling. If it is determined that a contestant is using the contest for gambling purposes, the contestant will be disqualified and reported to local authorities.

PUBLICITY RELEASE


13. Unless prohibited by law, participation constitutes permission for Sponsor, Exponentia and Contest sponsors, and their respective parents, subsidiaries and affiliates, without any further obligation or compensation (unless prohibited by law) to the Contest participant, the right to use and publish the participant’s proper name and likeness online and in print, or any other media in connection with the Contest without financial gain. Furthermore, Sponsor and its parents, subsidiaries and affiliates and Contest sponsors reserve the right to use any and all information related to the Contest, including information on participants obtained through the Contest, for marketing purposes or any other purpose.


INTELLECTUAL PROPERTY


14. All intellectual property, including but not limited to trademarks, trade names, logos, designs, promotional materials, web pages, source code, drawings, illustrations, logos, slogans and representations are owned by Sponsor, Exponentia Communications and Contest Sponsors and/or their parents, subsidiaries or affiliates. All rights are reserved. Unauthorized copying or use of any copyrighted material or intellectual property without the express written consent of its owner is strictly prohibited.

ADDITIONAL TERMS AND CONDITIONS

15. Sponsor reserves the right in its sole discretion to supplement or make changes to these rules at any time without notice. Sponsor reserves the right in its sole discretion to interpret these rules, and such interpretation shall be binding upon all participants. Sponsor shall not be responsible for any administrative errors involved in the execution of the Contest.
